How is the fee determined for an attorney handling a real estate sale?

Attorneys sometimes negotiate real estate contracts as part of their law practice, and in this case, the attorney would likely charge his or her usual fee, which could be an hourly rate, or it could be a flat rate. Alternatively, the attorney might opt for a percentage of the sales price, just like a real estate agent. 

If the seller used a lawyer to negotiate the contract, the lawyer could ask for a percent of the sales price as a legal fee. Many state real estate license laws exempt lawyers when they negotiate real estate sales “in the course of practice as a lawyer."  Lawyers fees are not fixed, so it is impossible to say what the lawyer would charge.  Your best advice is to ask the lawyer UP FRONT, before engaging him or her. 

A final note — if the property has title problems or there are other legal impediments to the sale (such as a need to evict a tenant), the lawyer’s fee will be higher than with a clean and simple transaction.
