That is one way it can occur, it will depend on your state and their laws as it could still end up in probate depending on the rest of the circumstances in your particular situation.
The best way to handle this is to put it in a trust. Either a land trust for the home or a living trust where you incorporate your will into it. Then everything you want to happen after your death you are able to set up now with a trustee to ensure your wishes are executed upon either of your deaths.
If my wife signs a quit claim deed on our property and I die leaving it to her in my will can she sell it & pay the mortgage off ?
