If you lied on your loan application and the home is foreclosed on two years later but the bank incurs no loss, will you be prosecuted?

Great question, I assume you have a “friend” in this situation.  I think the easiest answer is just to come out and say “no”….because nobody is going to waste their time and money prosecuting someone when they haven’t lost any money. 

Would you sue someone for backing into your car in the parking lot if it turns out that they didn’t actually damage the car?  No.

If you lied on your loan application, you committed Fraud on all kinds of levels, lets not even get into that.  The good news for you is that the bank did not incur any kind of loss…..that seems highly unusual, but hey, anything’s possible!  So You’ll probably get a free pass on this one, but I would also be concerned if you earn a living with any type of professional licensing such as: CPA, Insurance agent, Attorney, Realtor, Mortgage broker, financial planner, stock broker, etc……if you committed fraud in a financial transaction you may lose your respective license if it ever came out in the open.
