I’m sorry you must not only have to deal with your husband’s passing, but also estate issues. This is why having a will and probate is so important if you own real property.
You need to contact a real estate attorney that is located near the property in question as soon as possible. The attorney may be able to file a lis pendens (lawsuit pending) in your behalf. This alerts a potential purchaser, lender and title company that a party attempting to sell the property may not have clear title or the authority to sell the property.
You can find a real estate attorney by contacting a local (to the property) title company. Do not delay, do not listen to friends or relatives, do not attempt this as a do-it yourself project. Contact a title company and/or real estate attorney asap.
