Seller were to pay for closing costs but the lender had me pay for the AIM Fee before closing. After closing, I noticed that I didn’t get credited for it on the HUD-1. The lender entered it as a credit from the lender. As a result, I lost the $999 and the seller paid $999 less in closing cost. Since the HUD-1 had already been processed, title company said there’s nothing they can do.
Can I request for a refund from the lender based on the premises of:
1. Contract states the seller were to pay for closing cost but the lender still required me to pay for the AIM Fee before closing.
2. Lender incorrectly entered the amount as a credit from the Lender instead of a credit from me.
