Behind On My Second Mortgage

I have not missed a payment or been late with my first mortgage. I have been ill and out of work and could not pay the second mortgage. Can they go before the first and start to foreclose or just put a lien on my property?

As in the case of any mortgage, you are required to make the said designated payments within the terms of the agreement usually set apart due and payable every 30 days as determined in the body of the note, and based upon the initial signing.

However, that being said, you may wish to contact the mortgage servicer before they begin the foreclosure proceeding against you in order to attempt to create a forbearance arrangement such as one and a half payments per month in order to catch you up and ultimately put you in the place you were before your illness.
